Abstract
This paper provides a comprehensive exploration of the evolution of intellectual property rights in the digital domain, focusing on the role of the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement, the U.S. White Paper on Intellectual Property and the National Information Infrastructure Report, and the impact of the World Intellectual Property Organization (WIPO) Treaties. In the absence of specific rules within the TRIPS agreement pertaining to digital content, the U.S. proposed robust frameworks to address this gap, which subsequently influenced international agreements. Despite criticism and initial failure in U.S. Congress, these proposals paved the way for the WIPO Copyright Treaty (WCT) and the WIPO Performances and Phonograms Treaty (WPPT). Additionally, the paper delves into the legal precedent set by the "Sony Betamax case" and its influence on copyright infringement in the context of technological advancements. This study illuminates the complexities and challenges in applying these frameworks and offers a nuanced understanding of how intellectual property laws are continually evolving to accommodate the digital landscape.
